Can I receive both Worker’s Compensation and Social Security disability benefits at the same time?
Yes. However, to prevent what is viewed as “double-dipping,” your disability benefit may be reduced while you are receiving monthly Worker’s Comp payments. If your combined monthly disability and Workers Compensation payments exceed 80% of your pre-disability earnings, SSA makes a dollar-for-dollar reduction from your disability benefits in the amount of the excess. Your monthly Social Security Disability benefit usually will increase when your monthly Worker’s Comp payments cease, unless your settlement agreement provides for an additional award of lump-sum benefits. If our office is handling your worker’s comp claim, we will include language in the settlement agreement that characterizes the lump sum as being paid over the course of your remaining lifetime in order to minimize the potential offset from any lump sum settlement.
